These Terms of Use form a legal agreement between the user of the service and the operator of NEXA Community. These Terms apply to websites, applications, dashboards, customer management systems, business platforms, communication systems, AI-enabled features and other digital services that reference or link to these Terms.

Additional terms, policies, contracts, service agreements or product-specific conditions may apply to particular services. If there is a conflict, the product-specific agreement may control to the extent expressly stated in that agreement.

You must have the legal capacity and authority required under applicable law to use our services. If you use a service on behalf of a business, organization, employer or other legal entity, you represent that you are authorized to accept applicable terms and use the service on its behalf.

• We may require identity, organization or authorization verification.

Certain NEXA Community platforms may use hierarchical or role-based access structures, including administrator, CEO, manager, team leader, employee, telecaller, customer or other authorized roles.

Access to data and features may depend on account role, organization assignment, team relationship and permissions configured within the platform. Users must access only information and functionality they are authorized to use.

You agree not to use our services to:

• Violate applicable laws, regulations or legal rights.
• Commit fraud, impersonation, deception or unauthorized financial activity.
• Upload malware, malicious scripts or harmful code.
• Attempt unauthorized access to accounts, databases, servers or systems.
• Interfere with the availability, security or performance of our services.
• Scrape, extract or collect information without authorization.
• Send unlawful spam, abusive communications or unauthorized bulk messages.
• Upload information that you have no lawful authority to process.
• Reverse engineer, copy or exploit protected systems except where applicable law expressly permits it.
• Use our services in a manner that may expose NEXA Community, users, customers or third parties to legal or security risks.

Organizations and users who submit customer information, employee information, documents, leads, communication records or other data to our services are responsible for ensuring they have the legal authority and appropriate basis to collect, use, upload and process that information.

You are responsible for the accuracy, legality and quality of information you submit and for configuring appropriate access permissions within your organization.

Some services may provide artificial intelligence, automated analysis, generated content, recommendations, summaries, predictions or decision-support features.

AI-generated outputs may be incomplete, inaccurate, outdated or unsuitable for a particular purpose. Users must independently verify important information before making business, employment, financial, legal, medical, credit or other significant decisions.

Certain services may provide technology platforms, marketplace functionality, lead generation, customer management, loan application assistance, financial product information, referrals or connections to regulated financial institutions and service providers.

Unless expressly stated and legally authorized, NEXA Community does not represent itself as a bank, lender, deposit-taking institution, credit bureau, stock exchange, investment adviser or other regulated financial institution.

Our websites, software, applications, user interfaces, branding, logos, platform designs, databases, source code, documentation, graphics and other proprietary materials may be protected by intellectual property laws.

Except where expressly authorized, you may not copy, reproduce, modify, distribute, sell, license, reverse engineer or commercially exploit protected materials.

Our services may integrate with external hosting providers, payment gateways, communication providers, cloud services, AI providers, financial institutions, APIs or other third-party services.

Third-party services are governed by their own agreements, policies and availability. NEXA Community is not responsible for third-party services to the extent permitted by applicable law.

Certain products or services may require fees, subscriptions, commissions or other charges. Pricing, billing cycles, taxes, refund conditions and payment terms may be provided at the time of purchase or in a separate service agreement.

Users are responsible for providing accurate billing information and paying applicable charges when due.

We may restrict, suspend or terminate access where reasonably necessary to address violations of these Terms, security risks, suspected fraud, unlawful activity, non-payment, unauthorized access, misuse of services or legal requirements.

We disclaim warranties that are not expressly provided in a written agreement, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.

To the maximum extent permitted by applicable law, NEXA Community will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, business opportunities, goodwill or data arising from use of or inability to use our services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

To the extent permitted by applicable law, users and organizations may be responsible for losses, claims, liabilities or expenses arising from their unlawful use of our services, violation of these Terms, infringement of third-party rights or unauthorized processing of data.

These Terms are governed by the laws of India, without regard to conflict-of-law principles, subject to mandatory rights and protections available under applicable law.

Subject to applicable law and any mandatory dispute resolution requirements, courts having competent jurisdiction in Nashik, Maharashtra, India shall have jurisdiction over disputes arising from or relating to these Terms or the services.

We may update these Terms to reflect changes in our services, business operations, technology, legal requirements, security practices or other relevant factors.

The Last Updated date shown on this page indicates the most recent revision. Continued use of services after updated Terms become effective may constitute acceptance of the revised Terms to the extent permitted by applicable law.
